Supreme Court's Ruling on Federal Health Care

Washington D.C. – The U.S. Supreme Court on Thursday, June 28, 2012 at 10 AM rendered its decision on the federal health care law, Affordable Care Act (ACA), which included the Health and Human Services (HHS) mandate. In a 5 to 4 Decision the Supreme Court ruled that they found the health care to be constitutional. 

Chief Justice Roberts states, according to SCOTUSBlog.com, that “the mandate can be regarded as establishing a condition -- not owning health insurance -- that triggers a tax -- the required payment to IRS." Five Justices sided that the penalty if someone refuses to buy insurance would be a kind of tax that Congress can enforce by using its taxing power.

For nearly a century, the Catholic bishops of the United States have been and continue to be consistent advocated for comprehensive health care reform to ensure access to life-affirming health care for all, especially the poorest and the most vulnerable. The impact of the ACA is still being assessed, but the Church has been directly impacted in one significant fashion: the HHS Mandate flowing from the law that requires that all health insurance plans provide free contraception, sterilization, and certain abortion-inducing drugs.
